Welcome to GeneralCommonsNetwork ("we," "our," or "us"). These Terms & Conditions ("Terms") regulate your use of our yacht charter services and website located at generalcommonsnetwork.sbs (the "Service") operated by GeneralCommonsNetwork.
By reserving a charter or utilizing our Service, you consent to be obligated by these Terms. Should you not agree with any portion of these terms, then you should refrain from accessing the Service.
2. Service Overview
GeneralCommonsNetwork offers high-end yacht chartering services, including:
- Full-day yacht hire
- Evening boat trips
- Business getaways
- Exclusive celebrations
- Extended charters
Service provision is contingent on availability and climatic conditions. Service alteration or cessation rights are reserved at our sole discretion.
3. Booking and Reservations
3.1 Booking Process
Charter booking prerequisites:
- Minimum age of 18 years
- Accurate and comprehensive personal details
- Booking confirmation-dictated deposit payment
- Acceptance of these Terms & Conditions
3.2 Confirmation
Your booking is only confirmed after the payment receipt and our confirmation in writing. We hold the freedom to deny service to anyone based on our judgment.
3.3 Availability
All charters depend on the vessel's availability and appropriate weather status. We will strive to accommodate your requested dates and timings.
4. Payment Terms
4.1 Pricing
All fees are denominated in € and are inclusive of all applicable taxes, unless stated otherwise. Our prices may change without prior notice.
4.2 Payment Schedule
- Deposit: A required 50% of the total charter price is due at the time of booking
- Balance: Payable 48 hours prior to the charter's departure
- Incidental expenses (if any): Payable after the charter's end
4.3 Payment Methods
We accept widely used credit cards, electronic funds transfers, and certified bank cheques. Payment processing is performed using safe, encrypted technologies.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Entire amount refundable minus administrative fees
- Between 24 to 72 hours before departure: Half of the amount refundable
- Within 24 hours of departure: Non-refundable
5.2 Weather Cancellations
Should our captain deem the weather conditions perilous, we will propose to:
- Reschedule the charter to another available date at no extra charge
- Issue a complete refund if a rescheduling is unfeasible
5.3 Mechanical Issues
In case your designated vessel encounters mechanical failures, we'll attempt to arrange an equivalent vessel. If this is not possible, we'll provide a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Adhere to all instructions from the crew
- Utilize the safety gear provided when necessary
- Inform of any health conditions that may impact their safety
- Stay in assigned areas on the yacht
6.2 Prohibited Items
The following are prohibited on board:
- Glass products
- Illegal materials
- Weapons or firearms
- Excessive quantities of non-alcoholic beverages
- Animals (except with prior approval)
6.3 Conduct
Passengers are expected to behave in a courteous manner. Should behavior risk safety or disrupt others' experiences, we may end a charter prematurely without reimbursement.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the amount you've paid for your charter and are not accountable for:
- Injuries due to passenger negligence
- Personal belongings loss or damage
- Indirect, ancillary, or punitive damages
- Delays due to weather or events outside our control
7.2 Insurance Coverage
We uphold all-inclusive maritime insurance for our fleet and operations. Passengers bear responsibility for their own travel and personal insurance policies.
7.3 Assumption of Risk
Engaging in our charter services implies acknowledging and assuming the inherent risks associated with maritime activities, and you are responsible for your safety and well-being.
8. Modifications and Itinerary Changes
We retain the authority to adjust itineraries, navigation paths, or schedules due to meteorological conditions, safety priorities, or operation necessities. We shall endeavor to provide similar alternative experiences.
9. Force Majeure
Events beyond our control, including but not restricted to the following, release us from liability for delays, cancellations, or service alterations:
- Extreme weather conditions
- Catastrophes
- Official regulations
- Port terminations
- Technical malfunctions
10. Privacy and Data Protection
We manage your personal data complying with our Privacy Policy. By employing our services, you agree to our data accumulation and usage as outlined in the Privacy Policy.
11. Intellectual Property
Our website's material, including text, imagery, logos, and icons, is secured by copyrights and trademarks laws. Unauthorized reproduction, distribution, or derivations are forbidden without our written consent.
12. Governing Law
These Terms adhere to the laws of Germany. Disputes are to be adjudicated in the courts of Hamburg, Germany.
13. Changes to Terms
We reserve the capacity to alter these Terms periodically. Revisions will be announced on our website, marked with an updated revision date. Continued utilization of our services equates to the acceptance of modified terms.
